1. Who we are and what these terms cover
This website, dripconnect.ca, is operated by DripConnect ("DripConnect", "we", "us", "our"), based in Ontario, Canada.
These Terms of Service (the "Terms") apply to your use of this website and to every order you place with us. By browsing the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site.
Our Privacy Policy and Refund Policy are incorporated into these Terms by reference.
2. Eligibility
You must be the age of majority in your province, state, or country of residence, or have the consent of a parent or legal guardian, to use this site or place an order. You confirm that any information you give us is accurate and that you are authorized to use the payment method you submit.
3. Orders and acceptance
An order placed on this site is an offer to buy. It is not accepted until we send you a shipping confirmation. Until then we may decline or cancel any order, in whole or in part, for any reason, including suspected fraud, pricing or listing errors, stock shortages, or quantity limits.
If we cancel an order after payment, we will refund the affected amount to the original payment method. We will attempt to notify you using the email or phone number you provided at checkout.
We may limit quantities per person, household, payment method, or shipping address, and we may refuse orders that appear to be placed by resellers, dealers, or automated software.
4. Pricing, payment, and errors
All prices are listed in Canadian dollars (CAD) unless stated otherwise and are subject to change without notice. Applicable taxes are calculated and shown at checkout.
Despite our efforts, listings on this site may occasionally contain errors in price, description, availability, or imagery. We reserve the right to correct any error and to cancel or refuse any order placed on incorrect information, even after an order has been submitted and payment taken. Where an order is cancelled on this basis, a full refund is your sole remedy.
5. Products, descriptions, and sizing
We make a reasonable effort to display product colours, measurements, and condition accurately. Screen calibration varies, so colours on your device may differ from the item. Sizing, fit, and measurements can vary between brands, production runs, and garment types. Size charts and measurements are provided as guidance only and are not a guarantee of fit.
Products are offered in limited quantities and are subject to availability. We may discontinue any product at any time.
6. Shipping, delivery, and risk of loss
Delivery estimates shown at checkout or on product pages are estimates, not guarantees. We are not responsible for delays caused by carriers, customs authorities, weather, or events outside our reasonable control.
Title and risk of loss pass to you when we hand the parcel to the carrier. Once a parcel is scanned as delivered by the carrier to the address you provided, it is your responsibility. We are not liable for loss or theft after delivery, or for parcels sent to an incorrect or incomplete address you supplied. If a parcel is returned to us as undeliverable, we will contact you to arrange reshipment at your cost or issue a refund less shipping.
7. Duties, taxes, and customs on international orders
Orders shipped outside Canada may be subject to import duties, taxes, and brokerage or handling fees assessed by the destination country. Unless the checkout page expressly states that duties and taxes are prepaid for your order, these charges are the responsibility of the recipient and are collected by the carrier or customs authority, not by DripConnect.
We are required to declare the contents, value, and country of origin of every international parcel accurately and will do so. We cannot mark shipments as gifts or declare a value other than the price paid. Refused or abandoned parcels, and any duties or return fees incurred as a result, are the responsibility of the customer.
8. Returns, exchanges, and store credit
Our Refund Policy governs all returns and is part of these Terms. In summary: eligible items may be returned within 30 days of delivery, we provide the return shipping label at no cost to you, and approved returns are refunded as DripConnect store credit. We do not issue cash or original payment method refunds on returns.
Store credit does not expire, is not redeemable for cash, and is not transferable. Items must be returned unworn, unwashed, and in their original condition with any tags attached. We may refuse a return that does not meet these conditions.
Where an order is cancelled by us, or where we are required by applicable law to refund to the original payment method, we will do so.
9. Discount codes and promotions
Discount codes, offers, and promotions are issued at our discretion, apply only to the products and periods stated, cannot be combined unless we say so, hold no cash value, and may be modified or withdrawn at any time. We may void a code and cancel the associated order where a code has been obtained, shared, or used in a way it was not intended for.
10. Chargebacks and fraudulent activity
If you have an issue with an order, contact us first. Filing a chargeback on a delivered order without first contacting us may result in your account being restricted and future orders refused. We reserve the right to submit order, delivery, and communication records to your payment provider in response to a dispute, and to pursue recovery of amounts owed.
11. Accounts
If you create an account, you are responsible for keeping your credentials secure and for all activity that happens under your account. Notify us promptly of any unauthorized use. We may suspend or close an account that we believe is being used in breach of these Terms.
12. Acceptable use
You may not use this site or its contents: for any unlawful purpose; to solicit others to take part in unlawful acts; to breach any applicable law, regulation, rule, or ordinance; to infringe our intellectual property rights or those of any third party; to harass, abuse, defame, or discriminate against any person or group; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track the personal information of others; to scrape, spider, or crawl the site; to interfere with or circumvent the security features of the site or any related service. We may terminate your access for breaching any of the above.
13. Intellectual property and trademarks
All site content that we create, including text, layout, graphics, photography, and the DripConnect name and logo, is our property or is used with permission and is protected by applicable intellectual property law. You may not copy, reproduce, or use it commercially without our written permission.
All brand names, product names, and logos referenced or shown on this site are the trademarks of their respective owners. DripConnect is an independent reseller and is not affiliated with, authorized by, endorsed by, or sponsored by any brand owner, manufacturer, or trademark holder referenced on this site. Brand names are used solely to identify and describe the items offered for sale.
14. Third-party links and services
This site may link to or rely on third-party websites and services, including payment processors, shipping carriers, and marketplaces. We do not control those parties and are not responsible for their content, products, policies, or practices. Your dealings with them are between you and them.
15. Reviews, feedback, and submissions
If you send us reviews, photos, comments, or other submissions, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and publish them in connection with our business. We are under no obligation to keep submissions confidential, to pay for them, or to respond to them. We may edit or remove any submission that we consider unlawful, offensive, or otherwise objectionable.
16. Privacy
Personal information you submit through this site is handled in accordance with our Privacy Policy.
17. Disclaimer of warranties
The site and the services are provided on an "as is" and "as available" basis. We do not warrant that your use of the site will be uninterrupted, timely, secure, or error-free, or that the results obtained from it will be accurate or reliable. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
18. Limitation of liability
To the fullest extent permitted by applicable law, our total aggregate liability to you arising out of or relating to these Terms, the site, or any product purchased through it will not exceed the amount you paid for the order giving rise to the claim.
We will not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost data, or replacement costs, whether based in contract, tort, or otherwise, even if we have been advised of the possibility of those damages.
Nothing in these Terms limits or excludes any right or remedy you have under the Ontario Consumer Protection Act, 2002 or other applicable consumer protection legislation that cannot be limited or excluded by agreement.
19. Indemnity
You agree to indemnify and hold harmless DripConnect and its owners, employees, and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.
20. Termination
These Terms remain in effect while you use the site. We may terminate or suspend your access at any time, with or without notice, for any breach of these Terms. Obligations and liabilities incurred before termination survive it.
21. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page. The "Last updated" date above shows when the most recent change was made. Your continued use of the site after a change means you accept the revised Terms. It is your responsibility to review this page periodically.
22. Governing law
These Terms and any separate agreement under which we provide you services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts of Ontario, subject to any right you have under applicable consumer protection law to bring a claim in your own jurisdiction.
23. Severability, waiver, and entire agreement
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us and supersede any prior agreements. Any ambiguity is not to be construed against us as the drafting party.
